1. Who we are

TOEVA is a trading name of Samuel Nouaze, a sole trader (entreprise individuelle) registered in France under SIRET 979 105 616 00010, of 9 Rue des Colonnes, 75002 Paris, France. We are the data controller for the personal data described in this policy.

This policy explains how we handle your personal data when you visit toevashop.com or buy from us. Because we offer goods to people in the United Kingdom, we comply with the UK GDPR and the Data Protection Act 2018.

2. What we collect

  • Identity and contact data — name, email address, delivery and billing address, telephone number.
  • Order data — items purchased, order value, order history, correspondence with our support team.
  • Payment data — we do not store your full card number. Payments are processed by our payment providers, who receive your card details directly.
  • Technical and usage data — IP address, browser type, device information, pages viewed, referring site, and similar data collected through cookies.
  • Marketing preferences — whether you have consented to receive our emails.

3. Why we use it, and our lawful basis

  • To fulfil your order — taking payment, dispatching goods, handling returns and refunds. Lawful basis: performance of a contract with you.
  • To provide customer support — answering your queries. Lawful basis: performance of a contract, or our legitimate interest in helping visitors who have not yet ordered.
  • To send marketing emails — only where you have opted in. Lawful basis: consent. You can withdraw it at any time via the unsubscribe link in any email, or by emailing us.
  • To keep accounting and tax records — Lawful basis: compliance with a legal obligation.
  • To prevent fraud and secure our site — Lawful basis: our legitimate interest in protecting our business and customers.
  • To measure and improve the site, and to advertise — Lawful basis: consent, given through our cookie banner.

4. Cookies

We use cookies that are strictly necessary to operate the site, which do not require your consent. We also use analytics and advertising cookies, which we set only if you agree via our cookie banner. You can change or withdraw your choice at any time through the cookie settings on the site, or by clearing cookies in your browser.

5. Who we share data with

We share personal data only with organisations that need it to provide our service, and only under a contract that obliges them to protect it:

  • Shopify Inc., which hosts our online store and processes orders on our behalf;
  • payment providers, who process your payment;
  • carriers and logistics partners, who deliver your order;
  • email and analytics providers, who help us communicate with you and understand how the site is used;
  • professional advisers and authorities, where we are required to disclose data by law.

We do not sell your personal data.

6. International transfers

We are established in France, and some of our providers are located outside the United Kingdom. Where personal data is transferred out of the UK, we rely on an adequacy decision made by the UK government, or, where none applies, on appropriate safeguards such as the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses. You may ask us for a copy of the safeguards in place.

7. How long we keep it

  • Order and transaction records: six years after the end of the tax year in which the order was placed, to meet accounting and tax obligations.
  • Marketing data: until you withdraw consent, and then only a suppression record so that we do not contact you again.
  • Support correspondence: up to three years after the matter is closed.
  • Cookie and analytics data: as set out in our cookie settings, and generally no more than 24 months.

8. Your rights

Under the UK GDPR you have the right to:

  • be told how your data is used, and to access a copy of it;
  • have inaccurate data corrected;
  • have your data erased in certain circumstances;
  • restrict or object to our processing, including any processing based on legitimate interests;
  • receive your data in a portable format, and have it transmitted to another controller;
  • withdraw consent at any time, without affecting processing carried out before withdrawal;
  • object to direct marketing at any time, absolutely.

To exercise any of these, email support@toevashop.com. We will respond within one month. There is no charge, and we may ask you to confirm your identity first.

9. Complaints

If you are unhappy with how we have handled your personal data, please tell us first so that we can put it right. You also have the right to complain to the UK Information Commissioner's Office at ico.org.uk, or on 0303 123 1113. If you are in the EU, you may complain to your local supervisory authority, which for us is the French CNIL.

10. Children

Our store is not directed at children. Under the Data Protection Act 2018, a child in the UK can consent to online services from the age of 13; we do not knowingly collect personal data from anyone under 13. If you believe a child under 13 has provided us with personal data, contact us and we will delete it.

11. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last revised. Where a change is significant, we will bring it to your attention.
