Terms of service

1. Who you are contracting with

toevashop.com is operated by Samuel Nouaze, a sole trader (entreprise individuelle) registered in France under SIRET 979 105 616 00010, of 9 Rue des Colonnes, 75002 Paris, France, trading as TOEVA ("TOEVA", "we", "us", "our"). Email: support@toevashop.com.

By using this site or placing an order, you agree to these terms. Please read them before you buy. Nothing in these terms reduces your statutory rights as a consumer.

2. Eligibility

You must be at least 18 years old, and legally capable of entering into a binding contract, to place an order.

3. How a contract is formed

Your order is an offer to buy. We accept it, and a contract is formed, only when we send you an email confirming that your order has been dispatched. If we cannot accept your order — for example because an item is out of stock, or because we have identified a pricing error — we will tell you and will not charge you, or will refund you in full.

4. Products

We take care to describe and photograph our products accurately. Colours may nevertheless appear differently depending on your screen, and packaging may vary. Sizing guidance is provided as a guide.

5. Prices and payment

Prices are shown in pounds sterling (GBP) and include any tax we are required to charge, as indicated at checkout. Delivery charges, and any import VAT or duty payable at checkout, are shown separately before you confirm your order.

We may change our prices at any time, but changes will not affect an order we have already accepted. If a product's correct price is obviously lower or higher than the price shown, and the error is one you could reasonably have spotted, we do not have to supply at the wrong price.

Payment is taken at the time you place your order. If payment is not received or is reversed, we may cancel the order.

6. Delivery

Delivery timescales, costs and arrangements are set out in our Shipping Policy, which forms part of these terms. Goods are at our risk until they are delivered to you. Ownership passes to you when we receive payment in full.

7. Cancellation, returns and refunds

Your 14-day statutory right to cancel, our 30-day return policy, and your rights in respect of faulty goods are set out in our Refund Policy, which forms part of these terms.

8. Intellectual property

All content on this site — including the TOEVA name and logo, the "Individual Sleeve System" designation, text, photographs, graphics and page design — belongs to us or is used under licence. You may not copy, reproduce or exploit it commercially without our written permission.

9. Content you submit

If you submit a review, comment, photograph or other content, you confirm that it is your own, that it is lawful, and that it does not infringe anyone's rights. You grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our business. We may remove content that is unlawful, offensive or misleading.

10. Acceptable use

You agree not to use the site for any unlawful purpose, not to introduce malicious code, not to attempt to gain unauthorised access to it, and not to interfere with its operation or the experience of other users.

11. Our liability to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach, but we are not responsible for loss or damage that is unforeseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability:

  • for death or personal injury caused by our negligence;
  • for fraud or fraudulent misrepresentation;
  • under sections 9 to 11 and 49 of the Consumer Rights Act 2015 (goods of satisfactory quality, fit for purpose, as described, and services performed with reasonable care and skill);
  • for defective products under the Consumer Protection Act 1987.

We supply our products for domestic and private use. We are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.

12. Events outside our control

We are not liable for delays or failures caused by events beyond our reasonable control. If such an event occurs, we will contact you as soon as possible and the delivery date will be extended. If the delay is substantial, you may cancel the order and receive a full refund for goods not delivered.

13. Availability of the site

We do not guarantee that the site will always be available or uninterrupted. We may suspend, withdraw or restrict it for business or operational reasons, and will give reasonable notice where we can.

14. Privacy

We handle your personal data in accordance with our Privacy Policy.

15. Complaints and disputes

Please contact us first at support@toevashop.com. We aim to respond within five working days and to resolve matters informally. You may also seek free advice from Citizens Advice at citizensadvice.org.uk.

16. Governing law

These terms are governed by the law of England and Wales, and you may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may instead bring proceedings in your own courts. Nothing in this clause deprives you of the protection of any mandatory rule of the law of the country in which you are habitually resident.

17. Other terms

We may transfer our rights and obligations under these terms to another organisation, and will tell you if we do. You may only transfer yours with our written consent. This contract is between you and us; no other person has any right to enforce it. If a court finds any part of these terms unlawful, the remaining paragraphs continue in force. If we delay in enforcing these terms, that does not prevent us from enforcing them later.

We may amend these terms. The version in force is the one published on this page when you place your order.
